Heard Sri Lakshman Tripathi, learned counsel for petitioner and Ms. Archana Singh, learned Additional Chief Standing Counsel for the State.
Ms. Archana Singh, on instructions, submits that petitioner's representation has already been decided. Petitioner was not found fit as she does not possesses the qualifications, prescribed for appointment namely, possession of two years Diploma (D.Ed) along with T.E.T./C.E.T. Examination. It is submitted that since petitioner has passed B.Ed (Special), therefore, she is not entitled for appointment on the post of 'Assistant Teacher'.
In view of the said facts that once petitioner's representation has been decided and that is the only prayer made in the petition, then nothing survives for adjudication. However, liberty is extended in favour of the petitioner that if she, so desires, she may challenge the impugned order of rejection in appropriate proceedings, if legal grounds exists for doing so.
Accordingly, petition is dismissed as infructuous.
