Supplementary affidavit, filed today in the Court, is taken on record.
Heard learned counsels for the parties.
Petitioner, an Executive Engineer with the respondent-Purvanchal Vidyut Vitran Nigam Limited, Varanasi (for short "Corporation"), by the instant petition is assailing the order dated 16.07.2021 passed by Second respondent whereby penalty has been imposed under service rules.
Learned counsel appearing for respondents, at the outset, submits that the order is appealable before the Chairman. This fact is not being disputed by learned counsel for the petitioner.
In view thereof, the petition is disposed of as withdrawn with liberty to petitioner to take remedy of appeal under the Rules. It will be open to the petitioner to file stay application along with memo of appeal. In the event, such an appeal along with stay application is filed within three weeks from date, it is expected that before deciding the appeal, stay application shall be considered and decided in accordance with law by a reasoned and speaking order.
