Heard learned counsel for the petitioner and the learned Standing Counsel appearing for the State.
This petition has been filed with the following prayer:
"i. To issue a writ order or direction in the nature of mandamus directing the respondent no.2 to decide the representation dated 23.09.2020 without stipulated period as directed by this Hon'ble Court.
ii. To issue a writ order or direction in the nature of mandamus directing the respondent no.2 to remove the stop of wines from the present existence place i.e. situated at Mohalla Kayasthan, Puranpur, District Pilibhit (near Sai Degree College) to some another place".
The contention of the leaned counsel for the petitioner is that a wine shop has been opened near the Sai Degree College and Public Inter College and the students of the said Colleges face harassment by the customers of the wine shop.
A perusal of the petition reveals that the distance between the aforementioned Colleges to the wine shop has not been mentioned. It is for the petitioner who claims to be public spirited individual to first collect the basic facts before approaching this Court in a petition in public interest. The vague averment made in the petition would not entitle the petitioner for any relief under the circumstances.
This petition is, accordingly, dismissed.
