Contention on behalf of the petitioner is that Gram Panchayat Kaundari comprises of three village, vij (i) Kaundari, (ii) Yusufpur Nagalia, (iii) Karanpur. That said Panchayat came to be constituted in the year 2014. That on 6.11.2020 State Government issued Government Order No. 2578/33-3-3030-03 Ra. Ni. Aa/14 dated 6.11.2020 in regard to reconstitution and delimitation of Gram Panchayat falling within the area of jurisdiction of four districts, vij Gautam Budh Nagar, Sambhal, Gonda and Moradabad. That Assistant Development Officer (Panchayat), Development Block Dingarpur Kundarki, District Moradabad prepared a provisional delimitation list proposing Karanpur to be constituted as separate Gram Panchayat. The proposal was sent to the State Government which however was not accepted by the State Government. Challenging the action, it is urged that the State Government glossed over the vital facts that Karanpur is an revenue village, was Gram Panchayat till 1985 has the population of 1688, is closer to Panchayat Bhavan and that no opportunity was granted to the petitioner. On these contention petitioner seeks direction referred supra.
