The petitioner no.2 asserting himself to be the husband of petitioner no.1, has filed the present petition seeking a writ of habeas corpus alleging that the petitioner no.1 is in illegal custody of the respondent nos. 5, 6 and 7.
Sri Jhamman Ram, learned counsel appearing for the Staterespondents submits that in the absence of any material to demonstrate that the petitioners are married, the present petition would not be entertainable.
Sri Sunil Kumar Singh, learned counsel for the petitioners has not been able to controvert the aforesaid assertion of the learned AGA. He prays that the petition may be dismissed as not pressed, to which the learned AGA has no objection.
The petition stands accordingly dismissed.
