committed by the appellant his name could have been mentioned earlier in the FIR itself. There is no independent witness. A recovery of country made pistol has been shown but there is no evidence to connect that pistol with the commission of the offence. The recovered pistol has not been sent for forensic examination to ensure that the same was used in the commission of the offence. In the medical examination of injured Ashish, it has come that the gun shot injury was caused by unknown persons. No one had seen the incident and after two days from the date of incident the first informant changed his version and brought the name of the appellant in the matter. The named accused Chandra Pal concocted a false story in order to save himself as well as his family members and roped the present appellant in the case. The statements of the witnesses also show that their statement is based on hearsay and have no sanctity of legal evidence. Later on, the informant was examined by the IO on 19.11.2018 after two days from the date of incident in which he gave statement that the witnesses Vijay Veer, Anuj, Bhupendra, Sanjay, Rohit, Jagsain and Himanshu told him that at 8:30 a quarrel started between the accused appellant and Ashish son of Chandra Pal. The applicant Aditya was having a pistol and in order to kill Ashish and Rajan he fired on them who sustained injuries and fell down. Thereafter, the accused appellant ran away from the place threatening the others.
