The report of the C.J.M. dated 28.02.2020 is on the record. According to which the appellant Mahesh Kumar @ Pahowa has died on 26.05.2012. In support of his report, the C.J.M. has sent the statement of S.I. Mohit Kumar, statement of Gram Pradhan, statement of Somvati wife of Mahesh Chandra and statement of Jaman Lal son of Hori Lal and report of S.I. Mohit Kumar. Somvati has stated that her husband has died on 26.05.2012. The death certificate of the deceased is also appended with the report. Hence, the report of C.J.M. being in compliance of Circular No. 15/2005, VIII-110 April 19, 2005 and 04/Admin G-II dated Allahabad 18.01.2017 is hereby accepted.
As the legal heirs of the deceased have not come forward to proceed with the appeal, hence, the appeal stands abated.
The appeal is dismissed as abated.
