Applicants have preferred the present petition for non compliance of the judgment and order dated 16.12.2020 passed in Writ A No. 12007 of 2020 (Jay Karan and Others vs. State of U.P. and Others).

Today when the matter was taken up, it is informed by learned counsel for the opposite party that stay vacation application along-with counter affidavit has already been filed by the opposite party. This fact is also stated in the affidavit filed by the opposite party on 22.03.2021.

In the circumstances, unless and until submission raised in the application seeking vacation is adequately addressed and rejected no case for initiation of contempt proceedings is made out.

In the circumstances, learned counsel for the applicant is directed to file rejoinder affidavit in the pending writ petition within three weeks. If the rejoinder affidavit is filed within three weeks, the Writ Court will consider and decide, at least the said vacation application filed by the opposite party in the writ petition, expeditiously and preferably within a period of four months.

In view of the same, present petition is disposed of.
