Applicant has preferred the present Contempt Petition for non-compliance of the final judgment and order dated 27.1.2020 passed in Writ-C No.2719 of 2020 (Arvind Singh and 2 Others Vs. State of U.P. and 2 Others) . The operative portion of the order is reproduced hereinbelow-
" Consequently, we permit the petitioners to move the Collector/District Magistrate, Varanasi with a copy of their claim together with a certified copy of this order and place such materials as the petitioners may seek to rely upon. The Collector/ District Magistrate, Varanasi shall take a final decision on the application preferably within a period of three months of the receipt of a copy of the application.
The petition is, accordingly, disposed of . "
Today, when the matter is taken up, an affidavit of compliance has been filed by Shri K.R. Singh, learned Additional Chief Standing Counsel for the opposite party no.1, the same is taken on record. In pargraph-5 of the compliance affidavit it is stated that pursuant to the order passed by this Court a decision has already been taken on 15.02.2021.
Heard learned counsel for the parties.
Since the order of the writ court has already been complied with, therefore, no further order is required.
Accordingly, the present contempt application is dismissed.
In case, the applicant is still aggrieved with the decision of the opposite party, he has liberty to challenge the same before appropriate forum.
