Per contra Sri Abhishek Mishra, learned counsel for the complainant in his counter affidavit and supplementary counter affidavit refuting the submissions advanced by learned counsel for the applicant that so far as involvement of Car in question is concerned, subject matter of trial. According to him possibility of pasting sham number plate cannot be ruled out. It is further submitted by the learned counsel for the informant, that it is not the simplicitor confession before the police but it is also coupled with the recovery of the incriminating material on the pointing out of the applicant, the dead body of the deceased. So far as the matrimonial discord is concerned, it is evident that the applicant himself has dropped his wife to her parent place about four months back. On the earlier occasion too there was murmuring between them with regard to her complexion, later on by the intervention of the informant the said matter was ostensibly pacified but fact remains, that there were no having an emotional bonding between them. The marriage is only of five years and the wife was with her parent place for last four months. It is on the insistence of her husband, she joined the company of the applicant on the fateful day living behind her baby with her parent. The applicant is husband of the deceased who has got much more onerous responsibility to save his wife and abandoning his wife from last four months and thereafter insisting her to join him, without informing the other family members and lastly, hiding himself from the police. All these factors/ conduct it are cumulative, put in a linear way, at least prima facie establishes the involvement of the applicant in the commission of the offence.
