Heard Shri Sharad Sharma, learned counsel for the applicant, Sri Saurabh Pandey, Advocate holding brief of Sri Saksham Srivastava, Ms. Shubham Shree, learned counsel for the complainant and Sri V.K.Rai, learned counsel representing the State and perused the record.
By means of the present application the applicant, Abhishek Agrawal @ Abhishek Sahu is seeking his anticipatory bail in Case Crime No.0015 of 2021, under Sections 498, 323, 504, 506 I.P.C. and Section 3/4 D.P.Act, Police Station- Atarsuiya, District-Prayagraj.
On earlier occasion on 16.07.2021, the Court has referred the matter to the mediation centre with the hope and expectation that the parties would sit across the table and after having deliberation they will come out from feasible and acceptable to both solution.
But unfortunately today when the matter was taken up along with report from the mediation centre, it was mentioned that "Mediation Completed. No Agreement".
Under the circumstance, I find no good reason to grant any protection to the applicant.
The interim order granted earlier stand vacated, the anticipatory bail application is dismissed.
The Investigating Officer of the case is directed to proceed in accordance with law and submit its report under Section 173(2) Cr.P.C.
