Heard learned counsel for the applicant, learned AGA for the State, Mohd Zakir, learned counsel for the informant and perused the material placed on record.

It is submitted by the learned counsel for the applicant that he has been falsely implicated in the present case. It is next submitted that the specific role of firing has been assigned to Kashif whereas general role of assault has been assigned to all accused including applicant. It is further submitted that coaccused Suleman, having identical role, has been granted anticipatory bail by this Court vide order dated 13.12.2020 in Criminal Misc. Anticipatory Bail Application No. 9331 of 2020. Applicant is having no criminal history. He is languishing in jail since 28.10.2020 and in case he is released on bail, he will not misuse the liberty of bail and will cooperate in trial.

Mohd Zakir, learned counsel for the informant has opposed the prayer for bail, but could not dispute this fact that applicant is having no criminal history, no specific role has been assigned to him and also co-accused Suleman has been granted anticipatory bail by this Court.

Considering the facts and circumstances of the case and also perusing the material on record, without expressing any opinion on the merit of the case, let the applicant Yusuf , involved in Case Crime No. 1257 of 2020, under Sections- 147, 148, 149, 307, 506 IPC, Police Station- Kotwali City, DistrictBulandshahr be released on his furnishing a personal bond and two local sureties each of the like amount to the satisfaction of court concerned. It is further provided that this bail order available on the official website of the High Court will be taken to be the authentic one and certified copy shall be submitted before that court concerned as soon as it is issued.
