Heard learned counsel for the applicant Sri Alok Kumar Sharma holding brief of Sri Anjani Kumar Shahwal, learned A.G.A. for the State and perused the material on record.
The present bail application has been filed by the applicant with a prayer to enlarge him on bail in Case Crime No.699 of 2020, under Sections 395, 397, 412 I.P.C., Police Station Sikandrabad, District Bulandshahar.
Learned counsel for the applicant submits that according to F.I.R. on 14.09.2020 two unknown persons looted Rs.2,18,000/-. He further submits that co-accused Lakhan was arrested on 15.09.2020, from his possession Rs.1,65,000/alleged to have been recovered. In statement co-accused Lakhan, name of the applicant and Faisal surfaced. Co-accused Faisal has been already granted bail by co-ordinate Bench of this Court vide order dated 15.12.2020 in Criminal Misc. Bail Application Nos.43345 of 2020, therefore, the applicant is also entitled for bail. There is no possibility of the applicant of fleeing away from the judicial process or tampering with the witnesses and, in case, the applicant is enlarged on bail, the applicant shall not misuse the liberty of bail. It is next contended that the applicant is languishing in jail since 15.09.2020.
