Learned counsel for the applicant submits that according to F.I.R. version applicant to avail the benefit of old pension scheme, he presented forged and fabricated document and affidavit in the office of DIOS. He submits that applicant served in different departments, as Assistant Teacher on 24.01.1992 in Government Inter College, Sanda, Sitapur, thereafter, in the year 2000 as Subject Expert Kuchla Mainpuri, thereafter, as Assistant Teacher in Sri Chandra Kishore Shastri Inter College, Mainpuri from where he was transferred to Sri Gandhi Inter College Bidhuna, Mainpuri on 05.01.2014 and he was working as an incharge principal Bidhuna and during incharge period as a principal, he moved an application on 11.10.2019 for adding his past services in the service book. A letter was issued DIOS Auraiya on 09.10.2019 for presence in the office. A reply was also given on 09.10.2019. As per paper no.40, no any action was taken by the DIOS office and on 24.12.2019 in continuation of explanation, matter was closed. Thereafter, an F.I.R. has been lodged by the manager of the institution. There is no possibility of the applicant of fleeing away from the judicial process or tampering with the witnesses and, in case, the applicant is enlarged on bail, the applicant shall not misuse the liberty of bail. It is next contended that the applicant is languishing in jail since 17.09.2020.
