Heard learned counsel for the applicant, learned counsel for the State and perused the material on record.
The instant bail application has been filed with a prayer to enlarge the applicant on bail in Case Crime No. 374 of 2021, under Sections 147, 148, 149, 452, 323, 307, 504 IPC, registered at Police Station Kotwali Nagar, District Muzaffarnagar, during pendency of trial.
It is urged that there is cross case, inter se, parties. As per prosecution case, seven nominated persons are said to have assauled by lathi and danda, consequently, four persons were injured. It is further urged that the injuries of all the injured persons are simple in nature; on the side of the accused, two persons have received injury having lacerated wound, skull deep; both the parties are neigbours; applicant is languishing in jail since 30.06.2021, having no criminal antecedent. It has also been assured on behalf of the applicant that he is ready to cooperate with the process of law and shall faithfully make himself available before the court whenever required and is also ready to accept all the conditions which the Court may deem fit to impose upon him.
Per contra, learned AGA opposed the prayer for bail, however, does not dispute the fact.
