Heard learned counsel for the applicant and Sri Ashish Pandey, learned counsel for the opposite party.
This bail application has been moved to enlarge the applicant on bail in N.C.B. No. 26 of 2020, under section 8/20/29/60(3) of N.D.P.S. Act, Police Station Narcotics Control Bureau Lucknow, District Gorakhpur.
As per prosecution case, on information, the vehicle was apprehended, on which, 10 quintal 50 kilogram and 700 gram GANJA in 25 plastic bag was recovered; applicant was apprehended alongwith driver and khalasi of the vehicle; applicant also identified the receiver Jaihind Pal/Jai Kumar Pal, on being taken by the N.C.B. team to Muhammadabad, District Mau; aplicant has accepted his involvement in the statement recorded under section 67 of N.D.P.S. Act.
Learned A.G.A. has vehemently opposed the prayer for bail and submits that it is not in the public interest to enlarge the applicant on bail.
Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant.
Accordingly, the bail application is rejected.
