Heard learned counsel for the applicant and learned A.G.A. Perused the record.
This is the second bail application filed on behalf of applicant Santosh Kumar, in connection with Case Crime No.89 of 2019, u/s 498A, 304-B, 323, 506, 326, 316 I.P.C. and Section 3/4 of D.P. Act, Police Station-Bhadohi, District-Bhadohi. He is in jail since 19.6.2021. First bail application of the applicant was rejected by this Court on merits vide order dated 11.01.2021.
Except the period of incarceration, learned counsel for the applicant has been unable to point out any new ground which may convince the Court to allow the second bail application of the applicant. So far as the period of detention is concerned, in matters of such gravity the it cannot be said to be so long drawn out that on that basis alone the applicant may be enlarged on bail. Accordingly, the second bail application stands REJECTED.
However, learned trial court is directed to take up this matter on top most priority and make all necessary endeavours to conclude the trial as early as possible within a period of one year, provided the applicant would provide fullest co-operation in in concluding the trial.
Learned counsel for the applicant must serve the copy of this order upon the trial court within ten days from today.
