It is submitted by learned counsel for the applicant that on 14.10.2014 applicant was granted bail in this case by the concerned court below. Thereafter, he was regularly appearing before the trial court, but on account of non-appearance, N.B.W. has been issued against the applicant on 21.03.2015. It is further submitted that thereafter applicant was implicated in another case being case crime no 76 of 2016 under Sections 380, 411, 457 IPC registered at Police Station Bilari, Distirct Rampur, therefore, he was arrested and sent to jail on 20.03.2016. It is next submitted that on account of aforesaid reason applicant could not appear before the concerned trial court. It is also submitted that in case crime no. 76 of 2016 applicant has been granted bail on 01.02.2018 thereafter, he has surrendered in this case on 12.08.2019 and since then he is in jail. It is next submitted that non-appearance of the applicant before the trial court in this case was not deliberate, but due to unavoidable circumstances of the applicant. The applicant is languishing in jail since 12.08.2019 and in case he is enlarged on bail he will not misuse the liberty of bail and he will appear on each and every date before the trial court.
