Learned counsel for the applicant submits that the applicant has been falsely implicated in the present case. The impugned first information report has been lodged against nine accused persons. As per F.I.R., there is no specific role has been assigned to the applicant. As per medical report of injured, namely, Asif and Rashid, all injuries are simple in nature. It is next submitted that similarly placed co-accused, namely, Parvej Khan, Aurangzeb, Akhlak, Khursheed Khan and Javed Khan, Zulkarnain Khan and Asif Khan have been granted bail by this Court vide orders dated 29.7.2-20, 7.9.2020, 8.9.2020, 4.2.2021 passed in Criminal Misc. Bail Application Nos. 10630 of 2020, 23937 of 2020, 23963 of 2020,8199 of 2021 & 8193 of 2021 therefore, applicant is also entitled to be released on bail on the ground of parity. It has been assured on behalf of the applicant that he is ready to cooperate with the process of law and shall faithfully make himself available before the court whenever required. The applicant is languishing in jail since 23.5.2021. He undertakes that he will not misuse the liberty, if granted, therefore, he may be released on bail.
