Heard learned counsel for the applicant, learned A.G.A. for the State and perused the material on record.
The present bail application has been filed by the applicant with a prayer to enlarge her on bail in Case Crime No.139 of 2021, under Section 3/5/8 U.P. Prevention of Cow Slaughter Act, P.S. Nakur, District Saharanpur.
Learned counsel for the applicant submits that according to F.I.R. version applicant was arrested along with 50 kg. beef and it is alleged that one co-accused Mehboob fled away from the spot. He further submits that there is no scientific report that recovered material was beef. He further submits that due to village parti bandi false recovery has been shown against the applicant. He next submits that applicant is lady and there is no possibility of the applicant of fleeing away from the judicial process or tampering with the witnesses and, in case, the applicant is enlarged on bail, the applicant shall not misuse the liberty of bail. It is next contended that the applicant is languishing in jail since 05.04.2021.
Per contra, learned A.G.A. has opposed the bail prayer of the applicant and submits that the applicant has committed the alleged offence, therefore, he is not entitled for bail.
