Learned counsel for the applicant submits that general allegations of beating by lathi, danda and rod has been levelled against the applicant. He submits that the incident occurred on 14th January, 2021 and on the next day applicant was arrested and recovery of rod has been made. In statement under Section 161 Cr.P.C. informant has levelled general allegations and injured and other witnesses have also stated that rod was in the hands of the applicant. As per medical report, nine injuries have been found of which some are of serious nature. He further submits that a cross FIR was lodged as Case Crime No. 28 of 2021, under Sections 147, 323, 452, 504, 506 I.P.C. by the wife of the coaccused against the injured and others. Although, the FIR was registered on 01.02.2021 but the complaint was made on the same day of the incident. He further submits that applicant has a criminal history of three cases, in two cases he has been enlarged on bail and in one case his arrest has been stayed. There is no possibility of the applicant of fleeing away from the judicial process or tampering with the witnesses and, in case, the applicant is enlarged on bail, the applicant shall not misuse the liberty of bail. It is next contended that he is languishing in jail since 16.01.2021.
