Learned counsel for the applicant argued that the Learned counsel for the applicant argued that although the applicant is the husband of the deceased, Smt. Neeraj but he has been falsely implicated in the present case. It is argued that the deceased committed suicide by hanging herself, after which an information was given by Munna, the father of the applicant to the police which was recorded in the general diary and then her inquest was conducted and later on the postmortem was conducted. The postmortem examination report is suggestive of suicide as the deceased was found to have been received a single ligature mark on her body. The cause of death is Asphyxia due to ante-mortem hanging. Subsequently, the present first information report was lodged on 26.6.2020, after the postmortem examination was done implicating the applicant and four other family members alleging false, incorrect and concocted story. It is further argued that on 30.5.2020, Smt. Neeraj had consumed PPD rock salt which is a poisonous substance for committing suicide after which she was admitted in the hospital by the applicant and was given treatment therein. Even in the discharged summary, the Doctor has mentioned that the diagnosis is of deliberate self harm. It is argued that later on, she committed suicide and died. He further argued that the applicant has no criminal history as stated in para 28 of the affidavit and is in jail since 09.07.2020.
