Contention in brief is that the applicant being a lady has played no role in committing the offence in question. The allegation has been levelled against the present applicant only because she happens to be wife of one of the co-accused say Ram Murti Tiwari @ Dhangu. There is no iota of evidence showing any abetment being extended by the applicant to the deceasedPoonam Tiwari. The deceased in fact was obsessed with her husband, for which she of her own committed suicide, as a result of which, the applicant cannot be branded as an accused. The allegation made against the applicant is baseless and false and not applicable to the applicant. In this case, the husband of the applicant, say, Ram Murti Tiwari @ Dhangu, against whom the main accusation has been levelled has already been granted bail by co-ordinate Bench of this Court in Criminal Misc. Bail Application No.15033 of 2021 on 17.3.2021, copy whereof has been annexed as Annexure No. S.A.-1 to the supplementary affidavit filed in support of this anticipatory bail application. In case, the applicant is granted anticipatory bail, there is no possibility of absconding or misusing the liberty of anticipatory bail.
