The submission of the learned counsel for the applicants is that the applicants have been falsely implicated in the present case. Submission is that the deceased was married with one Manish in the year 2013. The applicants are not the family members of the said Manish and the allegation is that one application has been given by the deceased to the District Magistrate, wherein, it has been alleged that her husband is having relationship with some woman and they are harassing her in several ways and if no action will be taken, she will be compelled to commit suicide. Submission is that in the said application, applicants have not been named as they are not the family members of the husband of the deceased, hence, the provision under Section 498A I.P.C. is not applied to them. It appears to be as remote possibility that they anyhow abated the deceased to commit suicide. It has been submitted that the charge sheet has already been filed against the husband of the deceased for the aforesaid offence. In view of above, the prima-facire case for anticipatory bail is made out. It is further submitted that applicants have no criminal history and applicants are prepared to furnish surety and bond, there is no possibility of either fleeing away from the judicial process or tampering with the evidence, therefore, applicants are entitled for grant of anticipatory bail.
