At the very outset, learned counsel for the applicant submits that charge-sheet has been submitted and credible evidence against the applicant has been collected, as such, the present anticipatory bail application filed under Section 438 Cr.P.C. has become infructuous and the same may be dismissed as withdrawn.
Applicants' counsel have a remedy to approach before the court below and apply for regular bail under Section 439 Cr.P.C. and the court concerned shall decide the same in accordance with law.
Accordingly, the present anticipatory bail application is dismissed as withdrawn.
