Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.
The instant bail application has been filed on behalf of the applicant Suraj Singh with a prayer to release him on bail in Case Crime No.258 of 2018, under Section 302 I.P.C., P.S. Maharajpur, District Kanpur Nagar during pendency of the trial.
It is argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the present case. Present FIR has been lodged by Kisan, who is eye-witness, who carried the deceased to hospital and before whom deceased whispered the name of applicant. He next argued that during trial Kishan, who is eye witness and informant of the case, has stated some different version. On that account, no allegation of murder is assigned to applicant. He next argued that from perusal of medical report no case is made out and nothing has been recovered from the possession of the applicant.
Learned A.G.A. has opposed the bail prayer of the applicant and submits that there is a double murder case and informant has taken the name of applicant who has murdered the deceased.
Considering the entire facts and circumstances of the case and submissions of the parties and looking to seriousness and gravity of offence, evidence, complicity of the accused, without expressing any opinion on the merits of the case and considering the submission advanced, I find that no good ground is made out for enlarging the applicant on bail.
The bail application is accordingly, rejected.
However, the trial court is directed to decide the trial of the case in accordance with law, as expeditiously as possible, without granting any unnecessary or long adjournments to either of the parties, preferably within a period of one year from the date of production of a certified copy of this order, if there is no other legal impediment.
