This anticipatory bail application has been filed by applicants Rikant Kumar and Shivam @ Balram with the prayer to enlarge them on anticipatory bail in Case Crime No. 393 of 2020, under Sections 354, 354(Gha), 323, 504, 506 I.P.C., Police Station Dilari, District Moradabad.
At the very out set, learned counsel for the applicants submits that he does not want to press this anticipatory bail application provided that a direction may be given to the learned court below that if the applicants surrender before the court below and apply for regular bail their application for bail may be disposed of on the same day.
Learned A.G.A. submits that in the present matter, the police after completing the investigation has already filed charge sheet against the accused-applicants.
In view of above, the anticipatory bail application is rejected as not pressed.
However, it is directed that if the applicants surrender and apply for regular bail before the learned court below, the same shall be heard and disposed of expeditiously, preferably on the same day, in accordance with law.
