Heard learned counsel for the applicant and learned A.G.A for the State as also perused the record.

This application under Section 482 Cr.P.C. has been filed seeking direction to the court below for early decision of Case No. 1134 of 2008 (State vs. Om Prakash Nishad) arising out of Case Crime No. 1187 of 2007, u/s 223, 224 I.P.C., P.S.Shahpur, District Gorakhpur, pendign in the court of Additional Chief Judicial Magistrate, 03, Gorakhpur.

Learned counsel for the applicant has submitted that the applicant is suffering from many old age disease and in absence of full pension he is facing great hardship. It is further submitted that despite of regularly attending the court proceedings of impugned case crime, the case is being adjourned by the court below without any valid reason.

Considering the fact that the trial has remained pending since 2008, without expressing any opinion on the merits of the case, this application is finally disposed of with a direction to the court below to decide the aforesaid case in accordance with law, as expeditiously as possible, without granting any unnecessary or long adjournments to either of the parties, preferably within a period of seven months from the date of production of a certified or computer generated copy of this order, if there is no other legal impediment.
