Heard Sri Rajendra Kumar Singh, learned counsel for the applicant and Mr. Pankaj Saxena, learned AGA-I appearing for the State-opposite party.
The present application under Section 482 Cr.P.C. has been filed for a direction to the court below to decide the Special Sessions Trial No.30 of 2010 (State Vs. Sahab Lal) arising out of Case Crime No.521 of 2009, under Sections 323, 504, 506 IPC and 3(1)(X) of SC/ST Act, Police Station Jalalpur, District Jaunpur, pending before the Sessions Judge, Jaunpur, within a stipulated time.
Counsel for the applicant has referred to the order sheet of the case, copy whereof has been appended alongwith the affidavit filed in support of the application, to contend that the proceedings are at the stage of evidence and although several dates have been fixed in the matter but for some reason or the other the same has been adjourned and the delay in disposal of the case is causing undue hardship to the applicant. Accordingly, a prayer made in this application is to expedite the proceedings.
Having regard to the aforementioned facts and circumstances and without expressing any opinion on the merits of the case, the present application is disposed of with an observation that the court below would make an endeavour to decide the aforesaid case in accordance with law as expeditiously as possible, without granting any unnecessary adjournments to either of the parties, provided there is no other legal impediment.
