Heard Sri Deepak Kumar Tripathi, learned counsel for the applicants and Sri Jhamman Ram, learned AGA appearing for the State opposite party.
The present application under Section 482 Cr.P.C. has been filed seeking to quash the charge sheet no. 1/2020 dated 16.05.2020 and cognizance order dated 27.01.2021 as well as entire proceedings of Case No. 1408 of 2021 (State Vs. Navihusen and others) arising out of Case Crime No. 281 of 2020 under Section 3/5A/8 U.P. Prevention of Cow Slaughter Act and Section 11 of Animals Cruelty Act. 1871, Police Station-Khalilabad, District-Sant Kabir Nagar pending in the Court of Chief Judicial Magistrate, Sant Kabir Nagar.
Counsel for the applicants after making submissions to some extent fairly submits that the necessary ingredients for invocation of powers under Section 482 Cr.P.C. are not made out in the facts of the present case and accordingly, he does not wish to press the reliefs made out in the application. The reliefs sought are therefore, not entertained.
Learned counsel submits that the applicants would submit to the jurisdiction of the court below and seek bail.
In case any such application is moved by the applicants, the court below would be expected to pass appropriate orders thereon in accordance with the settled principles of law.
The application stands disposed of accordingly.
