Heard Shri Surendra Kumar Tripathi, learned counsel for the applicant and Ms. Sushma Soni, learned AGA appearing for the State-Opposite Party.
The present application under section 482 Cr.P.C. has been filed seeking a direction to the court below to decide the S.S.T. No. 42 of 2020 (State Vs. Niranjan) arising out of Case Crime No. 0485 of 2019, under section 354, 452, 504, 506 I.P.C. & 3(1) Da/Dha of SC/ST Act, Police Station-Malpura, District-Agra, pending in the court of Special Judge (SC/ST), Agra.
Learned AGA points out that the order sheet of the case, which is on record, reflects that in terms of the last order dated 22.1.2021, passed by he court below, summons were issued to the opposite parties and as such it would not be appropriate for the applicant to seek a direction for expediting the proceedings.
Counsel for the applicant fairly submits that he is not aware of the current position of the pending case and submits that he does not wish to press the application at this stage.
The application stands accordingly dismissed .
