Heard learned counsel for the applicant and learned A.G.A. for the State. Learned counsel for the applicant submit that the matter is likely to be compromised between the applicant and opposite party no. 2 as the dispute between the parties is matrimonial in nature.
In view of the aforesaid submissions, let the matter be placed before the Mediating Agency at District Agra, where the present case is pending.
The applicant is directed to deposit Rs. 1000/- to the Mediating Agency at District Agra within three weeks from today, out of which, Rs. 500/- shall be paid to the opposite party no. 2 for appearance before the Mediation Centre and Rs. 500/- shall go to the District Mediating Agency.
It is further directed that the Mediating Agency at District Agra, shall conclude the mediation and conciliation proceedings preferably within a period of two months from the date of appearance of the parties after giving notices to both the parties.
For a period of two months from today, further proceedings of Complaint Case No1742 of 2019, (Laxmi Narayan vs. Ghanshyam and others), under Sections 323, 504, 506, 406 I.P.C., P.S. Nibohara, District Agra, pending in the court of Judicial Magistrate, Fatehabad.
In case the aforesaid amount is not deposited within the aforesaid period, the application shall stand dismissed without reference to the Court, and the trial court is at liberty to proceed against the applicant in accordance with law.
With the aforesaid observation, the application stands disposed of.
