Heard Sri Azad Khan, learned counsel for the applicant and the learned AGA appearing on behalf of the State.
By means of this application, the applicant has prayed for quashing the impugned order dated 04.06.2019 passed by learned District & Sessions Judge, Mirzapur in Session Trial No.88 of 2019 (State vs. Prince Sonkar) arising out of Case Crime No.172 of 2019, under Section 21/22 of N.D.P.S. Act at Police Station Katra, District Mirzapur whereby bailable warrant has been issued against the applicant.
Contention of learned counsel for the applicant is that the applicant was granted bail on 29.08.2019 by learned Additional Sessions Judge, Court No.3, Mirzapur in the above mentioned case. On 04.06.2020, the learned court below rejected the bail of applicant and also issued bailable warrant against the applicant. Further contention of learned counsel for the applicant is that as a matter of fact on 04.06.2020 the police arrested the applicant in another case due to which the applicant could not appear before the court below. The applicant has no knowledge about the aforesaid bailable warrant dated 04.06.2020.
Considering the facts and circumstances of the case, it is provided that in case the applicant appears within 15 days of date and applies for recall of the warrant, the same shall be considered and disposed of expeditiously thereafter. Till disposal of the applicant' motion to recall the bailable warrant, no coercive steps shall be taken against him.
