The present application under section 482 Cr.P.C. has been filed seeking to quash the impugned charge sheet no. 45/20 dated 06.12.2020 in criminal case no. 09 of 2021 (Rubi vs Shailendra Yadav and others) arising out of Case Crime No. 029 of 2020 under sections 498-A, 323, 504, 506 I.P.C. and 3/4 D.P. Act, Police Station Mahila Thana, District Auraiya as well as cognizance order dated 04.02.2021.
Counsel for the applicant, at the very outset, fairly submits that the necessary ingredients for invocation of powers under section 482 Cr.P.C. are not made out in the facts of the present case and accordingly, he does not wish to press the prayers in the application. The reliefs sought are therefore, not entertained.
Learned counsel states that the applicant would submit to the jurisdiction of the court below and seek bail.
In case any such application for bail is moved by the applicant, the court below would be expected to pass appropriate orders thereon in accordance with the settled principles of law.
The application stands disposed of accordingly.
