Supplementary affidavit filed on behalf of the petitioner is taken on record.
Heard learned counsel for the petitioner and perused the record.
The prayer made by the petitoner is that a direction be issued to the Additional Judge Khafifa, Allahabad to decide the Execution Case No. 01 of 2012, filed for execution of decree dated 6.3.2012 passed in Case No. 79 of 2008, Roshan Lal Vs. Dilip Singh @ Dubri within a stipulated period.
Considering the facts of the case, without expressing any opinion on the merits of the petitioner's case, this petition is finally disposed of with a direction to the Additional Judge Khafifa, Allahabad to decide the Execution Case No. 01 of 2012, filed for execution of decree dated 6.3.2012 passed in Case No. 79 of 2008, Roshan Lal Vs. Dilip Singh @ Dubri in accordance with law without granting unnecessary adjournments to either of the parties as expeditiously as possible preferably within a period of three months from the date of production of certified copy of this order.If there is no legal impediment.
In case the adjournment sought by either of the parties the same shall be consider on heavy cost.
