Facts in brief are that one Smt. Sayeeda Nuzhat had filed SCC Suit No.47 of 2005 against petitioner-defendant for eviction of shops bearing Municipal No.10/806 (new No.10/668) as well as arrears of rent and mesne profits. In the said plaint, the petitioner-defendant was the tenant. The petitioner-defendant had filed written statement denying the averments made in the plaint. It is further alleged that during pendency of suit, the petitioner-defendant had filed application dated 06.02.2015 seeking information from the Central Shia Waqf Board, Lucknow with regard to nature of disputed shop and also sought the list of property under Khandani Imambara. On 14.03.2016, the petitioner-defendant had also moved an applications 110-C alongwith affidavit before the learned trial judge in which plaintiff-respondent had filed objection dated 15.03.2016. It is further alleged that the learned trial judge vide judgment and order dated 20.07.2017 rejected the application 110-C filed by petitioner-defendant. Being aggrieved, the petitioner-defendant had filed SCC Revision No.22 of 2017 (Akhilesh Kumar Jain vs. Khuda Vand Tala Waqf) before the then District Judge, Saharanpur, who dismissed the said revision vide order dated 27.08.2021, hence, this writ petition
