Heard learned counsel for the petitioner.

This writ petition has been filed praying for the following reliefs :-

(i) issue an appropriate order or direction calling for record of the case and set aside the impugned judgment and order dated 06.09.2021 passed by Additional District and Session Judge Fast Track Court No.2, Hapur in Criminal Appeal No.43 of 2019 CNR No. UPHP 01-002226-2019 (Deepak Vs. Sheetal Sharma and another) and impugned judgment and order dated 29.04.2019 passed by Civil Judge (Senior Division) Fast Track Court, Hapur in Misc. Case No.1422 of 2016 (Smt. Sheetal Sharma Vs. Deepak and others) arising out of the proceedings under section-12, 16, 17, 18, 19, 20, 21, 22, 23 of the Protection of Women From Domestic Violence Act, 2005.

Submission of counsel for the petitioner is that while passing the impugned order the money deposited by the petitioner has not been adjusted by the court below. Contention is that he is ready to file the application before the court concerned and the same may be decided as expeditiously as possible.

Considering the fact and without expressing any opinion on the merits of the case, this petition is finally disposed of with a direction an application may be filed before the court concerned within two weeks and the court below to decide the aforesaid application if any filed before it in accordance with law, as expeditiously as possible, without granting any unnecessary or long adjournments to either of the parties, preferably within a period of two months from the date of production of a certified copy of this order, if there is no other legal impediment.
