By means of present writ petition filed under Article 227 of Constitution of India, the petitioner has prayed for a direction upon the court below to decide the P.A. Suit No. 33 of 2019 ( Smt. Rekha Verma vs. Sri Srichand Gupta and another) pending before Judges Small Causes Court at District Agra expeditiously as well as further direction to the court below to decide the said suit within a stipulated period as may be fixed by this Court.

It is submitted by learned counsel for the petitioner that several dates were fixed but the respondent did not appeared before the court or filed their written statement. It is further submitted that till the filing of present petition respondent did not filed their written statement and using delay tactics for linger on the matter.

The writ petition is disposed off directing the Judges Small Causes Court at District Agra to consider and decide the P.A. Suit No. 33 of 2019 ( Smt. Rekha Verma vs. Sri Srichand Gupta and another), expeditiously, in accordance with law, after affording notice and opportunity to all the parties, from the date of presentation of a copy of this order, if there is no other legal impediment. However, it is also expected that court below shall make every endeavour to expedite the hearing of the said case in accordance with law without granting unnecessary adjournment to either of the parties

It is made clear that this Court has not expressed any opinion on merits of the case and it is for the concerned authorities to decide the same in accordance with law.
