Sri Madhav Jain, Advocate, has put in appearance on behalf of respondent and raised a preliminary objection that against the order impugned, the petitioner has remedy of filing revision under Section 25 of Provincial Small Cause Courts Act, 1887.
Sri Gaurav Sharma, learned counsel appearing for petitioner does not dispute this fact and states that he does not want to press the writ petition and wants to withdraw the same with liberty to file revision.
In view of the said fact, the writ petition is dismissed as withdrawn with the liberty, as prayed.
Office is directed to return certified copy of the impugned order after keeping a photocopy of the same on record.
