This petition is directed against an order passed by the appellate authority dated 23.1.2020, in so far as it stays the order dated 14.12.2018 which is the subject matter of challenge in appeal. It transpires that there exists an educational institution known as Adarsh Samaj Achhalda, district, Aurraiya which is being managed by a society known as Adarsh Samaj Achhalda. The society was originally registered in the year 1953. It appears that society was not renewed later and a fresh society was registered in 1985. This new society continued to manage the institution from 1985 onwards. It appears that in 2018 an objection was raised to the registration of new society on the ground that its registration is in teeth of Section 3(2)(A) of the Society Registration Act, 1860. The Assistant Registrar by his order dated 14.12.2018 sustained the objection and found the registration of subsequent society to be invalid. The order of Assistant Registrar has been challenged on different grounds. It has been urged that same set of members have formed the new society which is managing the educational institution since 1985.
