Heard the counsel for the petitioner and the Standing Counsel representing the respondent nos. 1 to 3 and Shri Omprakash Singh representing the respondent nos. 4 & 5.

In pursuance to the previous order passed by this Court, the Standing Counsel has received instructions and has handed over a copy of the same to the Court which is taken on record.

On the basis of instructions, the Standing Counsel has stated that Case Nos. T202005440303386 and T202005440303385 have been registered against the respondent nos. 4 & 5 for having illegally occupied the Gaon Sabha plot which has been allotted to the petitioner.

The counsel for the respondent nos. 4 & 5 states that he is in occupation of the disputed plot on the basis of a compromise between the respondents and the petitioner, and is, therefore, not liable to be evicted from the disputed plot.

I am not expressing any opinion on the merits of the claim made by either of the parties as the matter is already pending adjudication before the Assistant Collector in proceedings registered under Section 67 of the U.P Revenue Code 2006 (hereinafter referred to as Code 2006) .

The Assistant Collector, Tamkuhiraj District Kushi Nagar shall finally decide the Case Nos. T202005440303386 and T202005440303385 registered under Section 67 of the Code 2006 within a period of two months from the date a copy of this order is produced before him and shall take appropriate action in accordance with law within a period of one month depending on the decision taken by

him in the aforesaid cases.

With the aforesaid directions, the writ petition is disposed of.
