Only submission of learned counsel for the petitioner to challenge the order impugned is that the same has been passed behind his back without issuing any notice or opportunity of hearing.

The order impugned has been issued by the Executive Engineer U.P. Awas Vikas Yojna asking the petitioner to remove illegal encroachment over plots situated on Khasra no.2686 and 2687 situated at Mauja Naraich Tehsil Adamapur District Agra (Annexure-9). It is in dispute as to whether the said plots have been acquired by Awas Vikas Yojna Parishad or they are still in the ownership of the petitioner.

It is not possible for the Court to address the same, however, on the question of violation of principles of natural justice, it is directed that the petitioner shall approach the respondent nos.5 and 6, Chairman, U.P Awas Evam Vikas Parishad, Agra and Executive Engineer Agra respectively giving categorical reply to the notice dated 11.2.2020 appending the documents of her ownership over the land-in-question.

In case, such a representation is filed by the petitioner alongwith copy of this order within a period of three weeks from today, the same shall be considered by passing a reasoned and speaking order in accordance with law within a further period of four weeks, thereafter, under due intimation to the petitioner.

The writ petition is disposed of.
