Petitioner is the elected Pradhan of village Bhathwa Pandey, Post Dolchhapra, Vikas Khand Salempur, District Deoria against whom an enquiry under Section 95(1)(g) is pending. It is alleged that a final enquiry report has been submitted on 30.3.2019 which exonerated the petitioner yet the District Magistrate has not passed appropriate consequential order.
Though a counter affidavit has been filed justifying the order to conduct an enquiry but the same is silent with regard to passing of any final order.
In the facts of the present case the District Magistrate, Deoria is directed to take an appropriate decision on the basis of enquiry report submitted in the matter after due opportunity to parties within a period of two months from the date of presentation of a copy of this order. Writ petition is, accordingly, disposed of.
The concerned Authority/Official shall verify the authenticity of computerized copy of this order from the official website of High Court Allahabad and shall act accordingly without waiting for submission of the certified copy of this order.
