This petition is placed before the Court in Chambers by the Registry, as the precautions required to be taken up in view of the COVID-19 pandemic requires various strict measures, including following of social distancing etc. Consequently, the appearance of parties and their counsel/s is dispensed with. I have perused the records.

This writ petition has been filed for a direction upon the revisional authority to dispose of petitioner's stay application in pending Revision No.1251 of 2019 (Arun Chand Vs. Pragha Prakash), filed under Section 219 of the U.P. Revenue Code, within a stipulated period of time.

The revision has been filed in the year 2019. The ordersheet has been annexed according to which on both the dates when the matter was to be heard there was a resolution by lawyers to boycott the court proceedings.

It is clear from what is observed above that there is no unusual delay on part of the court concerned in deciding petitioner's stay application which may require any interference by this Court. This writ petition, therefore, stands disposed of with the direction that the revisional court would proceed to consider the petitioner's pending stay application, at the earliest possible, after resumption of normal working in the court concerned post lockdown on account of COVID-19 pandemic. In view of the judgment of the Supreme Court in the case of Salem Advocate Bar Association, Tamilnadu Vs. Union of India, (2005) 6 SCC 635, the parties shall not seek any unnecessary adjournment in the matter.

The concerned Authority/Official shall verify the authenticity of computerized copy of this order from the official website of High Court Allahabad and shall act accordingly without waiting for submission of the certified copy of this order.

Since this order has been passed in the peculiar facts and circumstances without hearing the counsels for the parties concerned, liberty however stands reserved to either of the parties to apply for recall/review of the order in case they feel so aggrieved.
