The District Inspector of Schools has filed his personal affidavit stating that after the order was passed by the Director of Education, granting permission for disposal of land, a three members enquiry committee was constituted. However, the president of the institution raised certain objections whereafter a new enquiry committee was constituted. This enquiry committee has submitted its report on 22.11.2019. The Inspector thereafter appears to have obtained some guidance from the District Magistrate, Fatehpur also. The District Magistrate has observed that since plot no. 783 area 0.0810 hectare is not recorded in the name of the institution, therefore, this plot be not sold. The president of the managing committee has also submitted his objection which is on similar grounds. Since plot no.783 is not recorded in the name of the institution as such the authorities would be justified in refusing to grant permission to transfer land of plot no. 783. So far as the other plots are concerned, in respect of which enquiry report is in favour of the petitioner and the District Magistrate has also granted approval, the Inspector shall allow the petitioner to transfer such land in terms of permission granted by the Director. Required action in that regard would be taken within a period of six weeks. In light of the direction aforesaid, this petition stands disposed of.
