In paragraph 9 of the writ petition it is stated that on 5.7.2014 the Additional District Magistrate (Land Acquisition), Gautam Budh Nagar transferred the amount of compensation in the account of District Judge, Gautam Budh Nagar for disbursement of compensation to the respective tenure holders, whose lands were acquired and award was declared. It is further stated that till date the amount of compensation has not been paid to the petitioners and the same is still lying in the account of District Judge, Gautam Budh Nagar. In paragraph 11 of the writ petition it is stated that the applications moved by the petitioners under Section 18 of the Act, 1894 dated 11.2.2014 has not yet decided by the respondent no.2. It is further stated in the aforesaid paragraph that Land Acquisition Rehabilitation and Re-Settlement Authority has not been constituted as provided under Section 51 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. It is further stated that after the new act came into force w.e.f. 01.01.2014, under Section 51 of the aforesaid Act it is provided for speedy disposal of the dispute relating to land acquisition, compensation, rehabilitation resettlement while exercising jurisdiction power and authority conferred on it by an under this Act. It is argued that inspite of the fact that the applications were submitted by the petitioners before the respondent no.2 on 11.2.2014 till date no decision has been taken on the same.
