Heard Sri Sheshadri Trivedi, learned counsel for the petitioner and Sri Pratik Chandra, learned counsel for the respondent nos.1 to 3.

Counter affidavit filed on behalf of the respondent nos.1 to 3 is taken on record.

Counsel for the petitioner submits that the relevant material is already on record alongwith the writ petition and that he does not wish to file a rejoinder affidavit.

With the consent of the parties the writ petition is taken up for final disposal.

Submission of the counsel for the petitioner is that the facts in the present writ petition and the controversy involved herein is similar to the facts of Writ-C No.14950 of 2020 (Kriti Giri Vs. State of of U.P. and 3 others) which has been decided by this Court today.

In the present case also, the reply/explanation furnished by the petitioner with regard to the charges of use of unfair means has not been adverted to in the remark against the name of the petitioner in the list appended to the impugned office memorandum dated 06.08.2020 whereby his semester examination for the session 2019-2020 has been cancelled with

a further stipulation that he would appear in the said semester examination during the session 2020-2021.

Counsel for the parties submit that the controversy being identical to the Writ-C No. 14950 of 2020, the present writ petition may also be disposed of in the same terms.

Having regard to the aforementioned facts and circumstances and as agreed to by the counsel for the parties, the writ petition is disposed of leaving it open to respondent no.1 to pass an order after according due consideration to the reply/explanation submitted by the petitioner within a period of two months from the date of presentation of a copy of this order. The order/office memorandum dated 06.08.2020, in so far as it relates to petitioner, shall abide by the fresh order to be passed as aforesaid.

It is made clear that this Court has not expressed its view with regard to the merits of the claim of the petitioner.
