Heard learned counsel for the petitioner, learned standing counsel for respondent nos. 1 to 4 and Sri Krishna Kant Singh, learned counsel for respondent no.5.
The petitioner, through instant petition, seeks a direction upon the respondents nos. 2 to 4 to stop construction work over certain plots of land alleged to be owned by the petitioner. The petitioner has also prayed for a direction upon the Sub Divisional Officer, Karvi, Chaitrakook, District Chitrakoot, respondent no.4, to decide the stay application of petitioner in pending suit (Computerized Case No. T202007190100769 of 2020- Ram Lal vs. Arjun Singh and others), which has been filed against respondents 6 to 28, who are private respondents.
As, admittedly, the petitioner has instituted suit proceedings against the private respondent nos. 6 to 28, against whom injunction is sought, we deem it appropriate to dispose of this writ petition by giving liberty to the petitioner to move an urgency application in the pending suit for consideration of the pending stay application, if any.
Wit the aforesaid liberty, the writ petition, stands disposed of.
