Petitioner is before this Court assailing the order impugned dated 31.3.2014 passed by the second respondent in Suit No. 9 of 2005 wherein the application 4(Ka)1 filed by the respondent no. 3 was allowed directing the petitioner to evice the shop in question within two months as well as the appellate order dated 13.2.2020 passed by the first respondent in Rent Appeal No. 1 of 2014 wherein the appeal filed by the petitioner was dismissed affirming the order dated 31.3.2014 (Annexure No. 4 and 7 to the writ petition).
At the very outset, learned counsel for the contestingrespondent submits that so far as the order impugned dated 31.3.2014, the same has already been executed and in response thereof the possession of shop in question has already been handed over to the respondent no. 3. In support of her submission, she has placed the relevant documents and the same are taken on record.
Confronted with this situation, learned counsel for the petitioner very fairly states that he does not want to press the writ petition and the same may be dismissed as not pressed.
Consequently, the writ petition stands dismissed as not pressed .
