Instructions are taken in the record.
Learned Standing Counsel on the basis of instructions submits that the recovery is being made of the first ACP benefits which were prematurely granted to the petitioner when he was not entitled to the same. The recovery is not in regard to the salary paid during training which is the subject matter of special appeal pending before this Court.
Faced with this, Shri Sanjay Singh, learned counsel for the petitioner seeks leave to withdraw the writ petition with a liberty to file fresh writ petition.
The writ petition is dismissed with liberty to file fresh writ petition.
